    On April 26th, USATT received a copy of the arbitrator’s report from retained outside counsel stemming from the American Arbitration Association (AAA) hearing that resulted from a complaint filed by athletes Raghu Nadmichettu and Mark Hazinski.  These two athletes were suspended for one year based upon a complaint filed by the USATT Board of Directors and a hearing decision made by the USATT Ethics Committee for the actions they took at the U.S. Nationals in December of 2009.  The athletes desired to participate in the 2010 Nationals Team Trials held at Texas Wesleyan University on March 3 – 4 (a U.S. Olympic Committee protected event). As a result, an expedited AAA hearing was held on March 3, 2010. The result of that hearing was that Raghu Nadmichettu and Mark Hazinski were allowed to enter that March 3 - 4 event and their suspensions were vacated.

    In the recently received arbitrator’s report, more detail was provided in support of the arbitrator’s decision. As a result, the suspensions of the six (6) athletes involved in the original player action that took place at the December 2009 Nationals were all vacated. Those athletes are therefore cleared to play in USATT sanctioned events.  USATT was found to not have sufficient notice in entry forms that specified in writing that if players were to default (boycott) for reasons other than injury or illness, then suspension as a consequence, could be a possible result.

    The net effect is that weaknesses were identified in the USATT Bylaws and internal processes that the Board is already considering for review and restructuring.  USATT will incorporate specific language in appropriate entry forms that will specify behavior and actions taken by athletes at events that can lead to disciplinary options. We are developing a Participant Code of Conduct that will include language deemed broad enough to cover instances like this player action at the heart of this matter.  The Board will consider all options that may be available to them to bring closure to this matter in their May meeting.
